ORDINANCE NO. 970467

 

Accepting various easements and deeds in Jackson, Clay and Platte Counties; releasing various easements; and directing the City Clerk to record the acceptance.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That various easements and deeds in Kansas City, Jackson County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

 

1. Easement Agreement for Drainage and Utilities from Hickman Mills Consolidated School District No. I, Instrument No. K0020832, book K2839, page 1545;

Section 4. That the legal descriptions for such properties listed in Sections 1, 2 and 3 are set forth in Exhibit "A", which is attached hereto and incorporated herein by reference.

 

Section 5. That the utility easement which was retained in Kansas City by Ordinance No. 31702, passed September, 1965, to vacate 38th Street North (formerly Chestnut Street), 37th Street Terrace North (formerly Maple Street), 37th Street North (formerly Cherry Street), 36th Street Terrace North (formerly Oak Street) and 36th Street North (formerly Cedar Street) lying between North Manchester Avenue and North Skiles Avenue; and North Manchester Avenue (formerly Washington Street), North Smalley Avenue (formerly Adams Street), North Tullis Avenue (formerly Jefferson Street) and North Skiles Avenue (formerly Madison Street) lying between 38th Street North and 36th Street North; and the east-west alleys lying between 38th Street North and 36th Street North from North Manchester Avenue to North Skiles Avenue, all in the plat of Randolph Heights, Second Addition, a subdivision in Kansas City, Clay County, Missouri, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 6. All that part of the platted utility easement located in the rear 5 feet of Lot 39, Block 3, Mission Lake, Third Plat, a subdivision in Kansas City, Jackson County, Missouri, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns as further evidence thereof.

 

Section 7. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the offices of the Recorder of Deeds for Jackson County, Missouri, at Kansas City, Clay County, Missouri, at Liberty, and for Platte County, Missouri, at Platte City, respectively.
