COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 970450

 

Approving the preliminary plat of Barryoak Hill on a 10 acre tract of land generally located on the east side of Little Blue Road, approximately 1,000 feet north of East 79th Street. (SD 0778)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Barryoak Hill on a 10 acre tract of land generally located on the east side of Little Blue Road, approximately 1,000 feet north of East 79th Street, and more specifically described as follows:

 

Commencing at the northwest corner of Lot 13, Summit Wood Lots 1-48, a recorded subdivision in Kansas City, Jackson County, Missouri, thence North 86 51'51" West a distance of 393.55 feet to a point on the west line of the Northeast Quarter of Section 13, Township 48, Range 32, said point being the true point of beginning; thence South 86 51'51" East, a distance of 1043.55 feet; thence North 01 47'15" East a distance of 417.42 feet; thence North 86 51'51" West, a distance of 1043.55 feet to a point on the west line of the Northeast Quarter of said Section 13; thence South 01 47'15" West along said west line, a distance of 417.41 feet to the point of beginning. Containing 10.0 acres.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval when the first plat is submitted and that the

developer make improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer enter into a deferral agreement for the construction of pavement widening on the east half of Little Blue Road to provide a 30:1 taper beginning at the

south property line of the site and going north, beginning with a collector street width

at such time as Little Blue Road is improved to the south as required by the

Department of Public Works.

 

5. That the developer dedicate additional right of way for Little Blue Road so as to provide a total of 30 feet of right of way as measured from the centerline of Little

Blue Road.

 

6. That the developer install hard surface roads and fire protection prior to construction beyond foundations.

 

7. That the developer extend water mains as required by the Water Services Department.

 

8. That the developer obtain a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area exceeds five acres.

 

9. That the developer submit a street tree planting plan for approval as part of the final plat and secure the approval of the City Forester for street trees planted on City right

of way, with a copy to be submitted to the Department of City Development. The

plan shall include size, type, species and placement of trees.

 

10. That the developer receive approval from the Board of Zoning Adjustment for any subdivision identification signs before receiving a permit for construction.

 

11. That the developer contribute $1,667.40 for 7 single family lots in lieu of parkland dedication in satisfaction of Section 66-128 of the Subdivision Regulations.

 

12. That a lot depth variance (3 to 1 ratio) for Lots 1 and 2 is hereby granted.

 

A copy of said preliminary plat is on file in the office of the City Clerk under Document No. 970450, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
