Rezoning a 5.4 acre tract of land generally located south of E. 69th Street, west of Richmond Avenue from District R-7.5 to District R-80, subject to a condition that only residential uses will be allowed. (14454-P)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0949, rezoning an area of approximately 5.4 acre tract of land generally located south of E. 69th Street, west of Richmond Avenue from District R-7.5 (Residential dash 7.5) to District R-80 (Residential dash 80), said section to read as follows:

 

Section 88-20A0949. That an area legally described as:

 

Lot 33, East Swope Highlands (Address: 7405 E. 69th Street); and

 

E 165 ft of S 171 ft, Lot 34, East Swope Highlands (6912 Richmond Avenue); and

 

W 140 feet of Lot 34 and W 140 feet of South 305 feet of Lot 34, East Swope Highlands (no address).

 

is hereby rezoned from District R-7.5 (Residential dash 7.5) to District R-80 (Residential dash 80), all as shown outlined on a map marked Section 88-20A0949, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof, subject to the following conditions:

 

1. That only residential use groups and categories are allowed on the property.

 

2. That any animal shelter operated on the property must comply with Section 88-315 of the Code and may not have more than fifteen sheltered dogs, not including any personal pets of the property's occupant, and not more than 25 dogs total allowed on the property.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
